Vic Judge in retirement home application

Justice Stuart Morris, Victorian Civil Appeals Tribunal (VCAT) President is the vendor of a one hectare block of land in Ivanhoe upon which a $21.5 million, 92 unit retirement village has been planned. The application has been lodged with the Banyule City Council by Rathmines Investments.

When this matter was raised in the media last month, conflict of interest concerns were raised, with residents questioning how to contest a development with VCAT which was connected with the VCAT President. Residents are expected to be formally notified of the development application next month.

Justice Morris said he would avoid any conflict of interest by distancing himself completely if any dispute involving the development came to VCAT and pointed out he was the vendor of the land not the developer of the retirement village.
